By accessing this website, purchasing merchandise, submitting inquiries, or entering into any partnership with Q House Motorsports, you agree to be bound by these Terms & Conditions.

These Terms apply to all users of the site, including browsers, customers, sponsors, vendors, and contributors of content.

Electronic acceptance of these Terms shall have the same legal effect as a signed written agreement.

INTELLECTUAL PROPERTY

All content, including but not limited to logos, graphics, photography, video, branding, text, race media, and digital materials, is the exclusive property of Q House Motorsports and/or Atlas Industrial Group LLC unless otherwise stated.

No content may be copied, reproduced, distributed, modified, displayed, or used commercially without prior written consent.

Unauthorized use of QHM intellectual property may result in legal action.

SPONSORSHIP AND PARTNERSHIP TERMS

All partnership benefits are promotional opportunities and do not constitute guaranteed advertising outcomes.

Sponsorship benefits represent promotional alignment and brand visibility opportunities, not guaranteed advertising performance metrics.

QHM does not guarantee:

• Podium finishes
• Race participation minimums
• Specific exposure levels
• Social media impressions
• Competitive performance results

Racing outcomes and exposure are inherently variable and dependent on factors outside of QHM’s control.

Placement and Activation
Brand placement, activation details, and media distribution may be adjusted based on equipment configuration, mechanical conditions, race scheduling, governing body regulations, and operational requirements.

PAYMENTS AND NON-REFUNDABILITY

Sponsorship payments are due according to the agreed schedule and must be received prior to activation of branding or promotional benefits unless otherwise agreed in writing.

Failure to remit payment may result in removal of branding, suspension of benefits, and termination of agreement.

Unless otherwise stated in writing, sponsorship fees are non-refundable.

TERMINATION AND MORALS CLAUSE

Q House Motorsports reserves the right to terminate or suspend any partnership if:

• Payments are not received
• A sponsor engages in conduct that materially damages QHM’s reputation
• Legal or regulatory issues arise involving the sponsor

QHM may remove branding at its discretion to protect team integrity and brand alignment.

MEDIA USAGE RIGHTS

Where media usage rights are granted:

• Rights are non-exclusive and non-transferable
• Use is limited to promotional purposes
• Media may not be altered, resold, sublicensed, or commercially distributed
• All QHM trademarks remain property of QHM and/or Atlas Industrial Group LLC

Sponsors represent that they have full legal rights to any logos or materials provided and agree to indemnify QHM against any claims arising from unauthorized use.

FORCE MAJEURE

Q House Motorsports shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including but not limited to race cancellations, injury, mechanical failure, governing body decisions, weather events, venue closures, or other unforeseen disruptions.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, QHM shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, business interruption, or loss of opportunity.

Total liability, if any, shall not exceed the amount paid for the specific product or service in question.

ASSUMPTION OF RISK

Motorsport activities are inherently dangerous.

Q House Motorsports and Atlas Industrial Group LLC assume no responsibility for injury, loss, or damages arising from attendance at or participation in racing events.

INDEPENDENT CONTRACTOR STATUS

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between QHM and any sponsor, customer, or third party.

INDEMNIFICATION

You agree to indemnify and hold harmless Q House Motorsports and Atlas Industrial Group LLC from any claims, liabilities, damages, or expenses arising from:

• Violation of these Terms
• Misuse of QHM intellectual property
• Unauthorized branding
• Infringement related to materials you provide

GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Texas.

Any disputes shall be resolved exclusively in the appropriate courts located within the State of Texas.

DISPUTE RESOLUTION

Any dispute arising under these Terms may be resolved through binding arbitration in the State of Texas, at QHM’s election, prior to litigation.

ATTORNEY’S FEES

In any dispute arising under these Terms, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

MODIFICATIONS

Q House Motorsports reserves the right to update these Terms at any time. Continued use of the website or services constitutes acceptance of any revisions.
